NETFIRMS™ BASIC HOSTING PLAN™ TERMS OF SERVICE AGREEMENT

If YOU accept this Agreement without reading it in its entirety, YOU are still bound by this Agreement in its entirety.

The following is the entire service agreement between Netfirms Inc. (NETFIRMS™) and you (YOU / YOUR).


1. Advertisements - NETFIRMS™ may at any time place either banner or "pop-up window" advertisements on each page of YOUR Web site (SITE). YOU will not modify, interfere with, or remove these advertisements.

2. Limitations -
  1. YOUR individual files stored on the NETFIRMS™ servers are not to exceed 256 kilobytes (KB) in size each;
  2. YOU are not permitted to store multimedia file types, executable binaries and / or compressed file types on the NETFIRMS™ servers;
  3. YOUR SITE may not include any content involving password restricted pages, moving pictures experts group layer two or three (MP2 or MP3) files, log files on non html content, any code that interferes with NETFIRMS™ advertisements, any binary files not linked to an html page on the SITE, and / or any links from any other providersŐ Web pages to YOUR SITE that do not first link to an html page at NETFIRMS™;
  4. YOUR bandwidth usage is restricted to 1 gigabyte (GB) per month, and no more than 56 MB per day. Excess daily usage may result in the disabling of YOUR SITE. Reactivation of YOUR SITE may require upgrading of your Web hosting plan;
  5. custom CGI script execution is restricted to 1000 executions per day. Executions in excess of this limit will result in disabling of the SITE, and YOU will be required to upgrade your hosting plan in order to reactivate the SITE;
  6. if YOUR SITE does not register any activity (i.e. visits or "hits" to YOUR SITE by others) for more than sixty continuous days, NETFIRMS™ may delete YOUR SITE with no notice or compensation to YOU; and
  7. remote-linking to NETFIRMS™ servers is not permitted.

3. Web E-mail -
  1. if YOU do not log into YOUR Web E-mail account for more than sixty continuous days, NETFIRMS™ may delete your account with no notice or compensation to YOU;
  2. outgoing e-mail is restricted to 100 messages per day; and
  3. you agree to receive e-mail announcements from NETFIRMS™ from time-to-time.

4. Amendments - you agree to be bound by any amendments made to the BASIC HOSTING PLAN™, from time-to-time, as posted at www.netfirms.com.

5. Termination - NETFIRMS™ may unilaterally terminate this Agreement and delete the SITE without any notice or compensation to YOU if there is no activity on the SITE for sixty continuous days or more, or you breach any term of this Agreement.
